Thank you for selecting the services, software, and website (collectively, the "Service") offered by Realbotics Corporation and/or its subsidiaries and affiliates ("us," "we," "Realbotics," or the "Company"). Please review these Terms of Service ("Terms") as this is a legally binding agreement between you and us. By accepting electronically (for example, by clicking "I accept" or by accessing or using Realbotics Services), you consent to these Terms. If you do not agree with these Terms, you may not use the Services.
Description of Service
Realbotics provides custom voice AI solutions, including conversational agents, automated call handling, client intake, and other interactive AI-driven services. Our Services are designed to enhance customer interactions, streamline processes, and provide a tailored experience based on client requirements.
Privacy Policy & Data Security
Usage of the Service is subject to Realbotics' Privacy Policy, which outlines our practices regarding data collection, usage, and storage. Realbotics follows industry standards to ensure data security; however, we cannot guarantee complete security. Realbotics does not knowingly collect personal information from children under 13 without parental consent, and users under 18 must have parental or guardian permission to use the Service.
Account Registration and Security
You may need to register for an account to access certain services. You are responsible for maintaining the confidentiality of your account and password and agree to accept responsibility for all activities that occur under your account or password. You may not assign or transfer your account to any other person or entity. Realbotics is not responsible for third-party access to your account resulting from theft or misappropriation of your credentials. You agree to notify Realbotics immediately of any unauthorized use of your account.
Billing and Payment
All Realbotics services are offered on a project or subscription basis as per the specific agreement with each client. Payments are due as specified in the contract, and a portion of the contract value may be required as a deposit before work commences. Failure to make payments as per the agreed schedule may result in service interruption. Realbotics reserves the right to terminate the services and any associated deliverables in the event of non-payment. No refunds are provided once services commence unless required by law.
Voice Data and Call Recordings
By using Realbotics’ voice AI services, you consent to the processing and handling of voice data and call recordings necessary to deliver and improve the Service. Realbotics may process, analyze, and store audio data to enhance AI performance and user experience. Clients are responsible for informing end-users of any call recording or data handling requirements under applicable laws. Realbotics shall not be liable for any misuse of recordings or voice data by clients.
Use of Service
You understand that you use the Realbotics Service at your own risk and that you are responsible for adhering to applicable laws regarding voice data and call handling. Realbotics is not liable for any consequences arising from the use of our AI-driven responses or actions. By using the Service, you agree to use it responsibly and not engage in any activities that could harm, disrupt, or otherwise misuse the Service.
Use of Communication Services
Realbotics may provide various communication services, including community forums, support channels, and chat features. You agree to use these services responsibly and for matters pertinent to Realbotics only. Harassment, spamming, spreading malware, and unauthorized commercial solicitation are prohibited. Realbotics reserves the right to monitor and remove any content deemed inappropriate and to terminate access to the communication services for violations.
Intellectual Property
Realbotics respects the intellectual property rights of its clients and third parties. Upon full payment, the client will own the final work product as delivered, including custom configurations, scripts, and workflows as specified in the project scope. This ownership does not grant rights to the underlying tools, frameworks, or methods used by Realbotics to create the work product.
Realbotics retains all rights, title, and interest in any pre-existing materials, libraries, algorithms, or other tools used to develop the client’s final work product. We also retain the right to use any ideas, techniques, or know-how developed during the project for future clients. Unless specifically agreed otherwise, there is no exclusivity granted to the client. This means Realbotics may use components developed for one client to create similar products for others.
Third-Party Services
Realbotics’ platform may include integrations with third-party services. You acknowledge that your use of these third-party services is subject to their respective terms of service. Realbotics is not liable for any issues or data breaches arising from third-party services.
Limitation of Liability & Disclaimer of Warranties
Realbotics provides the Service "as is" and "as available," without warranties of any kind, express or implied. Realbotics does not guarantee that the Service will be uninterrupted, error-free, or free of harmful components. Realbotics shall not be liable for any direct, indirect, incidental, special, or consequential damages, including lost profits or data, resulting from your use of the Service. Your use of the Service is at your own risk, and it is your responsibility to implement antivirus protection and data recovery procedures.
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Realbotics, its affiliates, and its respective officers, directors, employees, contractors, agents, licensors, and suppliers from any losses, costs, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party. You may not settle any claims on Realbotics’ behalf without prior written consent.
Arbitration
Any disputes related to these Terms will be resolved through arbitration in accordance with the rules of the American Arbitration Association before one arbitrator. Arbitration shall take place in the State of Delaware, and the language of arbitration shall be English. Any court of competent jurisdiction may enforce the ruling of the arbitrator.
Termination
Realbotics may terminate these Terms or suspend your access to the Service at any time, with or without notice, if you violate these Terms or engage in activities harmful to the Service or other users. Upon termination, your rights to the Service immediately cease, and Realbotics reserves the right to delete your data.
International Users
The Service is controlled, operated, and administered by Realbotics within the United States and may not be appropriate for use outside of the United States. International users are responsible for compliance with local laws.
Changes to Terms
Realbotics may revise these Terms at its discretion. Continued use of the Service after changes signifies acceptance of the revised Terms. Realbotics encourages you to periodically review the Terms to stay informed of updates.
Governing Law
These Terms and any dispute arising out of or related to them shall be governed by the laws of the State of Delaware, without regard to its conflict of laws provisions.
